1. Scope

1.1 These Terms and Conditions apply to all contracts between VK Projekte Media GmbH (hereinafter “VK Projekte Media”) and customers via the online shop premium-plugin.com.

1.2 Deviating conditions of the customer are not recognized unless VK Projekte Media explicitly agrees to their validity in writing.

1.3 All prices are exclusive of statutory VAT. Our offers are exclusively aimed at entrepreneurs (B2B) within the meaning of § 14 BGB.

2. Conclusion of Contract

2.1 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. Errors excepted.

2.2 By clicking the order button, the customer places a binding order for the digital products contained in the shopping cart. The contract is concluded when VK Projekte Media confirms the order by email immediately after receiving the order.

3. Prices and Payment Terms

3.1 The prices stated are exclusive of statutory VAT and other price components.

3.2 Payment is made in advance, via PayPal, or credit card.

3.3 The customer is obliged to pay the invoice amount immediately after the conclusion of the contract.

4. Delivery and Download

4.1 After receipt of payment, the customer will receive login data via email, with which they can log into the online shop and download the ordered digital products (e.g., Excel lists).

4.2 VK Projekte Media is not liable for delays caused by technical problems or force majeure.

5. Use of Data

5.1 The address data provided originates from public sources. The customer is responsible for ensuring that the legal requirements for using the data for advertising purposes are met, particularly obtaining consent from the data subjects (opt-in).

5.2 VK Projekte Media is not liable for the improper use of the data by the customer.

6. Right of Withdrawal

6.1 There is no right of withdrawal, as the ordered digital products are digital content that is not suitable for return.

7. Warranty

7.1 The statutory provisions on warranty apply.

7.2 The customer must report obvious defects in writing within 14 days of receiving the login data. Otherwise, warranty claims are excluded.

8. Limitation of Liability

8.1 VK Projekte Media is liable without limitation only for intent and gross negligence. For slight negligence, VK Projekte Media is only liable for breaches of essential contractual obligations (cardinal obligations).

8.2 In such cases, liability is limited to the foreseeable, contract-typical damage.

9. Data Protection

9.1 VK Projekte Media processes personal data of the customer for a specific purpose and in accordance with the statutory provisions.

9.2 Personal data will not be disclosed to third parties without the customer’s consent unless VK Projekte Media is legally obligated to do so.

10. Final Provisions

10.1 The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.

10.2 The place of jurisdiction for all disputes arising from contractual relationships between the customer and VK Projekte Media is the registered office of VK Projekte Media.

10.3 Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall not be affected.
